Domestic Energy Performance Certificates

Today we are all concerned with global warming, is our planet heating up? Is it man made? With this in mind the EU set out regulations concerning CO2 emissions under the Energy Performance of Buildings Directive (known as the EPBD) to control those CO2 emissions. This is where the concept of the Energy Performance Certificate (know as a EPC) came from. It is not just a Government regulation but a EU regulation that all houses must have a EPC. The government set out its targets to comply with the EPBD from the EU. The Government decided that when a property was marketed for sale, when a property was sold between two parties but has not been marketed or when a rental property was marketed that a EPC would be required. The EPBD is concerned with all buildings and air conditioning not just domestic properties, look at my  commercial EPCs page for EPCs for commercial premises.

For those people that own their home you will need to have an EPC when you sell or lease it. For landlords you will need an EPC when you market a property for rent.

The changes to Energy Performance Certificates 21 May 2010

From 21st May 2010 the government have changed the rules concerning Domestic Energy Certificates, the following is an extract of the press release by the government:

The duties relating to HIPs are set out in Part 5 of the Housing Act (sections 155 to 159). The Government has decided to suspend the HIP duties with immediate effect pending their outright abolition at the earliest opportunity. The effect of this is to provide that sellers and estate agents are no longer required to have or to provide copies of HIPs with effect from 21 May 2010.

In order to ensure that people selling their homes continue to make an Energy Performance Certificate available to prospective buyers, we have also laid before Parliament the Energy Performance of Buildings (Certificates and Inspections) (England and Wales) (Amendment) Regulations 2010 which introduce a number of new requirements including:

  • a new duty on the seller to secure that an energy performance certificate (EPC) has been commissioned before marketing of the property commences where no such certificate is already available
  • an EPC has been commissioned when a Domestic Energy Assessor has been instructed to prepare the EPC and the EPC has either been paid for or has given a clear undertaking to pay for it
  • a new duty on the person acting on behalf of the seller to be satisfied that an EPC has been commissioned before commencing marketing
  • a new duty on both the seller and a person acting on their behalf to make reasonable efforts to secure an EPC within 28 days
  • all of the new duties carry fixed penalties where somebody fails in the duty conferred on them by the new regulations

As you can see the responsibility is now on the seller to provide the Energy Performance Certificate. Always remember even if your home has a valid EPC and you have done work on your property, i.e. extra low energy lights, new boiler etc.. it is worth updating your EPC to reflect the current state of the energy efficiency of your property
